Dear Neighbors,

This is not a pro or anti-bike lane screed.

This is a note to share what some of us have learned about the installation
of bike lanes. There are a few concerns to bring to the fore based on the
new plans.

These concerns are liabilities for DDOT and for those in positions to make
decisions or to pause and reflect on the installation.

The plans indicate that the travel lane for NC Ave will be 12 feet wide. *Fire
Code **503.2.1 states that: ** Fire apparatus access roads shall have an
unobstructed width of not less than 20 feet, and an unobstructed vertical
clearance of 13 feet 6 inches.)* An alternative was provided by Delancey
Gustin to the ANC last year that would allow for safety vehicles and bikes.
It's been stated that emergency vehicles can access the highway or Ward 7
via East Cap, but that does not resolve access to homes on North Carolina,
1300 block.

Residents can hold city employees accountable if residents have made clear
the liabilities of a plan and if those in positions to clarify or amend
plans according to those liabilities do not take action (Federal Tort
Claims Act). The liabilities of this block's plan include but are not
limited to:

   1. Damage to persons and/or to property parked along NC Ave NE due to
   road narrowing;
   2. Damage to persons and/or property due to the installation of bike
   lanes next to the curb in an area where several residents with grave
   mobility issues reside (ADA compliance);
   3. Damage to property and/or persons due to increased traffic past Maury
   Elementary on 13th and Constitution Ave. (300+ vehicles according to DDOT
   staff);
   4. Damage to persons and/or property due to increased traffic past Minor
   Middle School on 15th and Constitution Ave. (300+ vehicles according to
   DDOT staff);

Finally, a question, as DDOT begun the National Environment Policy Act
review? Under that Act, the determination -- even a Finding of no
Significant Impact -- must be made available to the public prior to
construction start. (

These concerns were communicated to DDOT, but have not yet been resolved or
addressed.

Again, this is not pro- or anti-bike lanes. This is a note to urge careful
consideration of serious alterations to this block.
