[Lincolnparkdc] Bike lane or sidewalk/crosswalk makes a difference in our assessment here

I agree it is legal to bicycle on a sidewalk in a non commercial area.
However, I think the statement by one witness that he was in the crosswalk has to be considered against other facts.
We don’t know how far from the intersection the witness was when the accident occurred and therefore how good a view she had.
The bike riders statement that he was at fault.
The fact the front tire of bicycle hit the REAR (presumably right) tire of the car. This suggests to me the bike hit the car rather than vice-versa.
The fact the bicyclist did not receive any significant injuries. Less likely if the car had hit him.
I agree the car would have continued after the collision. However one also has to consider the bicycle was on the ground north of the crosswalk.
Please also remember the bicyclist may have reasons he does feel safe identifying himself to the police.
Please note I’m NOT saying the bicyclist wasn’t in the crosswalk, but there is also several facts to suggest he might not have been.
The fact the accident was heard at a distance suggests the bicyclists hit the car at some speed. Does the bicyclist not also have an obligation to operate at a safe speed, particularly if was also operating on a sidewalk where pedestrians (including young children) also a legal right to be present.
