I'm pretty sure that has always been illegal. My understanding is that the new law was supposed to put everything in a nice, clearcut package that drew distinct lines and was enforceable. I believe the intention was actually to clarify and to carve out more definable sanction for the allowable owner-occupied short-term rental market in a murky legal environment where most everything was technically illegal.
Technically legal/illegal is one thing. Enforcement is another. Since the law was passed by Council in 2019, every few months I've asked DCRA what the status was since the law had to be codified into DC regulations, etc to come practically into force. Last time I checked a few months ago, that process, which initially was assumed to take several months, hadnt been fully completed/signed off on, etc. yet. Maybe it has by now. I'll check. If someone has better information at their fingertips, please chime and add/correct/amend.
Still, whatever....it is, I believe illegal. My suggestion is to report it on 311 or call DCRA directly. And let me know by email. Lynn, send me an email offline and give me the details.

no, as far as I know it is NOT legal. Airbnb’s should only be one room in an "occupied by homeowner" home but because no one says anything they get away with it. You should email our ANC person Steve Holtzman. I will add him to this email although I believe he keeps an eye on our list serve as well.
